Court: Sunita can see Arvind Kejriwal's reports, meet his doctors

NEW DELHI: A Delhi court on Saturday allowed medical records of chief minister Arvind Kejriwal to be supplied to his wife, Sunita Kejriwal. The court of special judge Kaveri Baweja also allowed his wife to independently consult the doctors of the medical board treating the Delhi CM in jail. The board, which comprises doctors from All India Institute of Medical Sciences, Delhi, was formed by the orders of the court in April this year for treatment of Kejriwal in jail.

However, noting the submissions of the counsel appearing for Tihar Jail, the court refused to allow the presence of Sunita Kejriwal during his consultation/meeting with doctors. "This court sees no reason to carve out an exception for the applicant by going against the prison rules, more particularly in view of the submission of the jail authorities that several other inmates are also undergoing treatment for the same ailment as the applicant and who have also not been permitted to have an attendant," the court stated.

Citing Rule 479 (C) of the Delhi Prison Rules, 2018, the law officer of Tihar Jail stated that the jail rules permit a family member of an inmate as an attendant only where the prisoner is admitted in a hospital outside the jail premises. The counsel for the prison also submitted that there are several patients suffering from Type II diabetes-the same ailment from which Kejriwal is also suffering, and it will not be equitable to give preferential treatment by permitting his family member as his attendant during medical consultations with the board.

Kejriwal, in his plea, had requested the court to direct the jail authorities to allow his wife to be his attendant during the medical check-ups/follow-ups/consultation with the medical board/doctors. He said that his wife's presence was required to understand instructions of the doctors about his diet and medication.

On July 3, the court had reserved the order on his plea after he told the court that he was making the plea on "humanitarian grounds".

Rejecting the submissions of Kejriwal's counsels that the court had allowed a family member of MP Sanjay Singh to accompany him to his visits to a private hospital, the court said that the order cannot serve as a precedent in Kejriwal's case.

On the prayer of granting access to Kejriwal's medical record to his wife, the court said that the prison authorities did not object and Kejriwal told the court that his medical records were being duly shared.

Calling the submissions justified with regard to queries pertaining to the method of preparing the diet as per recommendation of the medical board, for which she may need to consult the doctors/medical board of AIIMS, the court allowed Sunita Kejriwal to "independently approach the concerned medical board/doctors, who may have a meeting/consultation with her to discuss the method of preparation of medically prescribed diet of the applicant, if so permitted under the hospital rules".
