INDORE: Almost five hours after the deadline set by the MP high court, the Madhya Pradesh police at 11.10 pm on Wednesday filed an FIR against state minister Vijay Shah for endangering sovereignty of the nation and making assertions on a class of people likely to cause disharmony. Shah, who was seen making the derogatory comments in videos viral on social media, is facing charges under non-bailable sections of BNS – with some carrying maximum punishment of seven years of prison term and fine.
Earlier, a division bench of the high court comprising Justice Atul Sreedharan and Justice Anuradha Shukla took a suo motu cognizance of Shah’s remarks calling Col Sofia Quereshi as ‘sister of terrorists’ and directed the state’s director general of police (DGP) to file an FIR against him Vijay Shah by 6 pm.
The court described the comments as ‘dangerous’, ‘disparaging’ and ‘language of gutters', while asking MP DGP to file an FIR.
“The same must be done by today evening, failing which tomorrow, when the matter is listed, the Court may contemplate proceeding against the Director General of Police of the State for contempt of this Order,” the court said.
At around 11.10 pm, DIG Nimish Agarwal said, “Following the court order, Manpur police registered a case against minister Vijay Shah under sections 152 (acts endangering the sovereignty, unity, and integrity of India), 196(1)(b) (committing any act which is prejudicial to the maintenance of harmony between different religious, racial, language or regional groups and which disturbs or is likely to disturb the public tranquillity), 197(1)(c) (making any assertion concerning the obligation of any class of persons by reason of their being members of any religious, racial, language or regional group or caste or community and such assertion is likely to cause disharmony or feelings of enmity or hatred between such members and other persons) of the BNS.”
SP Hitika Wasal confirmed that an FIR was filed against minister Vijay Shah.
Section 152 of the Bharatiya Nyay Sanhita (BNS) is a cognizable and non-bailable offense, punishable with imprisonment for life or imprisonment for a term of seven years along with a fine. Similarly, Sections 196(1)(b) and 197(1)(c) are also cognizable and non-bailable offenses, each carrying a punishment of up to three years of imprisonment.
A video of Shah went viral on social media platforms on Tuesday in which he is seen referring to the Pahalgam attack by Pakistan-based terrorists and Operation Sindoor launched by the Indian armed forces against terror launchpads in Pakistan in which he made indecent and objectionable remarks against Col Sofiya Qureshi.
He made the comments during a ‘Halma’ programme— a tradition to volunteer for environmental work—held in Raikunda village in Dr Ambedkar Nagar (Mhow) on Monday.
After drawing widespread criticism over the remark, he tendered an apology while talking to reporters on Tuesday evening and again on Wednesday evening in a video message.
