While husbands are often dragged to court for alleged demands of dowry, one particular man has pulled an uno reverse card of sorts by slamming his wife’s family for giving him “dowry without a demand.”
Additional Sessions Judge Navjeet Budhiraja was reviewing a man’s appeal challenging a July 2022 decision by a lower court, which had dismissed his plea for filing an FIR against his wife’s parents and brother, accusing them of giving him a dowry. It was also noted that the man was already facing a cruelty case filed by his wife's family.
The court stated, “Until both parties present their evidence in trial, it’s impossible to conclude whether dowry was indeed demanded. Therefore, at this stage, the revisionists' claim that he never demanded dowry but received Rs25,000 and Rs46,500 in his account remains self-serving." Judge Budhiraja, in his October 5 order, acknowledged that the man's in-laws had previously filed an FIR against him under Section 498A of the IPC, relating to cruelty towards a married woman by her husband or his relatives.
The court also referenced the magistrate's observations, which highlighted that, during the FIR registration, the in-laws admitted to giving dowry—a statement considered an offense under the Dowry Prohibition Act. Moreover, the court noted that Kumar had omitted the fact that his wife and in-laws had filed an FIR with “serious allegations of persistent dowry demands” against him.
The magistrate’s dismissal order pointed out that Kumar’s repeated claims that he had never demanded dowry, despite allegedly receiving it without request, were unsubstantiated and seemed like an "attempt to mislead the court.” The court concluded that the magistrate had “suitably addressed” the issues raised by Kumar, finding no grounds to deem the magistrate’s decision improper.
